Appellate Litigation
GSRM is well known for its representation of clients in a broad range of appeals at both the state and federal levels.
The firm’s attorneys argue cases before the Tennessee Supreme Court and the Court of Appeals in all three Grand Divisions of the state and handle administrative appeals in the Chancery Court.
Several members of the litigation group are licensed before the United States Supreme Court and appear regularly before the United States Court of Appeals for the Sixth Circuit in Cincinnati. Several GSRM attorneys are members of the Judicial Conference for the Sixth Circuit. Members of the firm also appear before courts of appeals for other federal circuits.
Alternative Dispute Resolution
Whenever possible, GSRM litigators explore alternative dispute resolution (ADR) options to help clients avoid the delays, stress, and cost of litigation.
The litigation team includes Tennessee Supreme Court Rule 31 certified mediators and a certified administrator for the National Association of Realtors’ Code of Ethics, Arbitration and Mediation Program.
Business Litigation
- Commercial Landlord and Tenant. GSRM frequently represents clients involved in litigated lease disputes and disputes about the interpretation of lease provisions, such as common area maintenance charges and options. The firm represents both landlords and tenants.
- Construction. GSRM attorneys have developed in-depth experience in construction contract issues and claims procedures due to their extensive representation of general contractors, subcontractors, and owners.
- Employee Relations. Though the firm has traditionally represented employers, its members often apply their experience to protect the interests of an individual client who, for example, may be terminating his or her employment relationship with a non-client company.
- Franchise. GSRM litigators are well-positioned to provide experienced representation for franchisees and small business owners in their disputes with franchisers and/or other business entities.
- General Business and Corporate. GSRM attorneys have a broad range of experience in litigating and resolving business and commercial disputes, including cases involving claims of breach of commercial contracts, non-competition agreements, employment contracts, business dissolutions, and other commercial disputes.
- Real Estate. In real estate litigation, the firm has represented title insurance companies and private parties in real estate title disputes, judicial foreclosures, and proceedings involving injunctive relief against foreclosures, mechanics' lien issues, and actions to remove clouds on title, among others. Firm members also have extensive backgrounds in representing property owners in eminent domain proceedings against governmental authorities in state and federal court.
- Consumer Financial Services. GSRM attorneys have broad experience in representing mortgage lenders, mortgage brokers, title companies, title insurers, and other financial institutions and lenders. We represent these parties in matters involving state and federal statutes and regulations respecting truth-in-lending, fair credit reporting, predatory lending, consumer protection, foreclosure, repossession, and other consumer finance matters.
- Alcoholic Beverage Issues. GSRM represents hotels, restaurants, and other retailers in alcoholic beverage matters. In addition, the firm has represented distillers regarding their relationship with wholesale distributors and the legal requirements applicable to that relationship, including involvement in several appellate decisions in that area.
General Litigation
- Trusts and Estates. Members of the firm have a broad range of experience in litigation involving trust interpretation, will construction, and will contest litigation as well as other types of litigation relating to trusts and estates.
- Product Liability. GSRM litigators have represented both plaintiffs and defendants in product liability litigation.
- Railroad and Transportation. GSRM trial attorneys regularly represent railroads in FELA cases, grade crossing accident cases, Railway Labor Act litigation, FLSA cases and other employment litigation, OSHA matters, and Federal Railways Safety Act cases. Several GSRM attorneys are members of the National Association of Railroad Trial Counsel and have taken part in and presented seminars held throughout the United States on railroad litigation topics. GSRM trial attorneys also regularly represent bus and trucking companies.
Public Law
- Communications Regulatory Proceedings. The telecommunications industry and its regulation have undergone a continuous transformation from a system of regulated monopolies toward a system based on competition. GSRM attorneys actively participate in numerous proceedings before the Tennessee Regulatory Authority dealing with the adaptation and implementation of new statutory and regulatory policies and rules concerning entry, rates, tariffs, services, and practices of telecommunications carriers.
- Constitutional Law. The rapid change in economic, social, and political conditions and perspectives has resulted in the enactment of numerous new statutes, raising new constitutional issues and the implementation of old constitutional policies to new circumstances. GSRM attorneys have participated in numerous cases involving the application of constitutional principles to statutes and agency actions.
